Drafting of methodologies for the review and analysis of the electronic communications market

The mission which was held between July 22 until 25, 2019 was dedicated to the discussion of European regulatory framework (Framework Directive, Access Directive and other relevant directives as well as SMP Guidelines and Recommendation on Relevant markets) and the principles of market analysis, in particular broadband access markets, termination markets, and retail voice markets.

The whole process of ex-ante market analysis was presented and explained in more details, which is based on anticipated activities and foresees three main stages, i.e, market definition, SMP analysis, and imposition, maintaining or amendment of appropriate obligations on an operator if it enjoys a dominant position (has SMP) or withdrawal/non-imposition of obligations if there is effective competition in the market under investigation.

It was agreed to continue the work related to market analysis, in particular related to data collection and in-depth discussion of the difference between market definition and focusing on finding SMP and co-SMP, which would imply further presentation of the principles of the SMP Guidelines.
